Apple Leads all PC Makers

Apple can’t seem to get out of the news lately, which makes sense if you consider that they are have been jockeying back and forth with Exxon for honor of being the biggest corporation in the world, and that recently, the head of this mega-tech corporation, Steve Jobs, passed away. Add to these minor facts a report by internal Apple auditors that revealed numerous violations of worker’s rights and working conditions at the plants that supply Apple components, and it’s easy to see how they might find their way into the press every now and then.

On the positive side of Apple news is a new report showing that if you take into consideration the iPad, Apple is now the largest maker of personal computers in the world. They have over 17% of total market share, having distributed 20 million pc type devices in Q4, 2011 alone. Apple topped former king of the hill, Hewlett-Packard, which has a market share of 12.7%. The others at the top of the heap among PC makers are Lenovo, Dell, and Acer.

The introduction and wildly popular tablets by Apple, Amazon’s Kindle, and the Nook by Barnes & Noble are changing the way that people look at the pc and along with it, drastically changing the face of the industry. If you take tablets out of the equation, pc sales in the U.S. actually fell by 0.4% for Q4 2011. If you include these devices, the market grew by 16%. So, the numbers tell the story. The public likes what they get from a tablet and that many don’t need or don’t want all the other functionality that comes with a full-blown pc.

The public appetite for table devices poses an especially vexing problem for HP, which tried and failed with the launch of their WebOS version of this product and now are back to the drawing board and back into the Windows camp. To this point Microsoft versions of the tablet product have not been well-received and until Windows 8 hits the market and these devices, the mega computer software giant and those using this operating platform are far behind the pack.

Analysts expect that overall PC sales will continue to be impacted by tablet sales, especially with the launch of the iPad3 expected very shortly. And while Apple hasn’t announced an exact date for the introduction of the new tablet, most industry experts believe that it will be a huge hit.

My take:

Apple continues to leave everyone else in their dust. It won’t be long before these tablets are able to do as much as a traditional pc or laptop, in fact, that’s probably the next product that will come rolling out of their factories in the near future. I won’t be surprised if Apple is the first company to make a hand-held pc.

Mickey D’s Gets Bad Tweets

Not everything that McDonalds comes up with is a big hit, especially when their big ideas aren’t about the Big Mac or bigger fries.

A recent marketing effort by McDonalds that encouraged the public to respond to their promotional Tweet “tell us what you think of us” might have been a step in the wrong direction. While the smarty pants in the McDonald marketing department thought that this would be a great way to use this social media outlet to promote their already omnipresent brand, it also had the unintended consequence of opening up McDonalds to some pretty outlandish comments, and not all of them flattering.

Within just a few hours of the campaign, the McTweet had over 72,000 replies and while company spokespeople say that the overwhelming majority were positive, many weren’t causing McDonalds to

shut down the Tweeter link just a few hours after posting it. Only 2% of the replies were said to be negative but that among them were outright lies, fabrications, and ev

en worse, comical and catchy stories and one-liners that didn’t paint the burger giant in the most attractive colors.  One such tweet is said to have been particularly bothersome to McDonald’s management saying, “One time I walked into McDonald’s and I could smell Type 2 diabetes in the air.”

No one at McDonald’s wants their product to be associated with diabetes, no matter the source of the quip.

McDonald’s acknowledges that it made a mistake in asking for public opinions and then having them posted on Twitter, but it isn’t something that is going to kill their brand or hurt the stock price. However, their underestimating the power, both positive and negative, from using social media as a marketing tool, highlights just how misunderstood this medium is even among the most supposedly sophisticated marketing executives.

My take:

Wow, it’s a good thing that McDonald’s didn’t ask me what I think of them. But then again, I might not be qualified to answer since I never eat that food since it is poison. On another level, I would expect McDonald’s to realize that they have people that love them and others that hate them so by opening themselves up to be the butt of jokes across the Internet is surprising for such an accomplished brand.

Made In America Not So Easy

Buy American. It’s a slogan that you hear all the time from would-be do good’ers trying to support American workers and lately, it’s a key component of the Obama Administration’s plans to get the American economy back up to speed. However, producing goods in the U.S. versus importing them from overseas isn’t as easy as it might appear.

In the first place, labor and material costs here in the U.S. are much higher than abroad making the first hurdle a difficult one. After that, regulations that guide everything from the specs on the factory, to environmental issues, to laws governing workers’ rights all add to the high cost and the difficulty associated with staring a factory in the U.S.

One longtime importer of her products turned U.S. manufacturer knows all too well the high cost and the high hurdles that have to be overcome to produce goods in the U.S. Mei Xu, owns a candle company and recently decided to manufacture her product in the U.S. instead of importing her candles and accessories from Vietnam and China. However in doing so she found that the regulations required to open the factory space that she purchased in Baltimore, MD., were not even exactly known by the local authorities and by the time she was able to get a straight answer, it took her six more months to get up and running and it cost her nearly $2million.

A Florida inventor of a Corona bottle opener has been trying to find a U.S. manufacturer for his product since 2007 but he cites the high cost of labor as one of the reasons that he was yet to find someone to produce his item.

My take:

It will take a lot of growing pains to get American factories up and running again because there are so many other entities involved and many of them haven’t been involved for a while given the decrease in manufacturing in the U.S. These entities are the local and federal agencies that give out the permits and the workers that do everything from building the factory to those that work in the plants. Sounds like a job for a big, big name like Warren Buffet to tackle.

DC Occupiers Can’t Camp in Parks

A federal judge ruled today that the government ban on camping in Washington’s McPherson Park is illegal and that the Occupy Movement protesters camping their now will have to remove their gear pronto.

The judge, James Boasberg, in response to a suit filed by protester Dane Primarano, said that camping in the park is not a first amendment right of the protesters, as Primarano argued saying that it was a matter of free speech, and that it was a matter of public policy, and that policy says no camping in the park.

National Parks police and local police told the occupiers that they had to remove all gear such as sleeping bags, cooking materials, etc.; but that they could keep their tents up as long as one flap of the tent remained open at all times.

The protesters have struggled to find ways to keep the momentum of their movement going through the cold months of winter as authorities are tightening their control over the groups by not allowing them to set up camps in the parks. The warmer months don’t present nearly as many challenges to the tenacity of the protesters as do the winter months so the judge’s ruling on the no camping regulations at McPherson Park come as a setback to the group.

The judge is expected to rule on another matter before the court in which the Occupy D.C. movement is seeking an injunction against the police and their right to seize private property without any evidence of a crime having been committed. The protesters say that the police have no right to seize their tents, sleeping bags, or anything else at the DC occupy site without a crime having been committed by the protesters.

The DC occupy movement is part of a larger movement across the U.S. and in other parts of the world against the disparity of wealth, power, and influence between the majority of the people and a tiny minority of the most rich and powerful people in the country.

My take:

The powers that be will do all they can to dismantle, disrupt, and degrade the Occupy Movement and that it will pass into the night with little or no real changes coming from their efforts. You have to give them credit for their nerve and determination at making their point, but the machine is very powerful and vengeful so beware.

Skin Cancer Drug Gets Fed Ok

Skin cancer is a growing problem all over, but especially in the U.S. with so many people taking to the sunnier aspects of life. As outdoor activities pick up, whether simply lying in the breeze, or enjoying outdoor activities like golf, fishing, hiking, boating, or biking, to name just a few, more and more people are out in the sun. And from what the scientific community tells us, the sun is stronger and stronger every year, at least the part that reaches Earthlings, and therefore being out in the sun poses ever greater risk of contracting skin cancer.

The FDA today approved and new drug for skin cancer called Erivedge, which is for the treatment of basal cell carcinoma or BCC, the most common form of skin cancer. The drug was approved though a fast track process at the FDA called the priority review program, which can get drugs deemed of critical benefit, reviewed and on the market in just six months.

The drug is limited in its application to those patients not being treated with radiation, surgery, or for those whose cancer has already spread.  The drug is most effective on BCC and is said to cut off a pathway for growth in most basal cell cancers.

This is the first FDA approved medicine for the treatment of this type of skin cancer. It comes in the form of a pill that patients take once a day.

The downside of the drug, known as a pathway inhibitor, is that the effects of the drug on the tumors are not as long lasting as other treatments but researchers are still working on making these drugs as effective as other treatments such as chemotherapy. Other side effects that have been exhibited by some patients treated with Erivedge are muscle spasms, hair loss, weight loss, changes in their sense of taste, and with pregnant women, the risk of birth defects.

My take:

Skin cancer is getting to be more and more of a problem. I can’t tell you how many people I know that have died from this seemingly harmless disease, to those that are being treated in the hopes that it doesn’t spread. I hope that this drug can indeed do what they say and that eventually they will find a way to completely eradicate this disease. Otherwise, we’ll just have to stay indoors and look at the lovely day from behind our windows.

The High Cost of Buying Influence

Everyone knows that the companies, and interests with the most to gain, the most to lose, and with the most to spend, put their money to work in buying influence in Washington. And among the biggest purchasers of our political system are the banks and financial institutions lining Wall St.

Spending by these financial institutions in 2011 topped $150 million, the second year in a row that these firms spent that amount in order to get their point across with the lawmakers that more often than not will be deciding on a host of laws and regulations governing the financial industry.

Top on the list of issues raised, and money thrown at by the finance giants is the Dodd-Frank regulation and all of its many policy changes enacted with the movement to reform Wall Street business practices.

Those with the most to spend among the banks and investment houses were Wells Fargo at $7.8 million, JP Morgan Chase at $7.6 million, Goldman Sachs at $4.4 million, and Morgan Stanley at $2.4 million. As is often the case, these institutions declined comment when contacted about the amount of spending directed by their companies at Washington lawmakers.

One of the topics of most concern to the Wall Street community has to do with capital that they are now required to keep in reserve as a safety net for bad investments, such as the mortgage backed securities that helped to fuel the financial meltdown. Banks have always had reserve requirements but now these have been increased, which means that the banks have to keep more of their powder dry than they would like, their preference being putting more capital to work in making more and more money.

The other topic of concern is the huge and largely misunderstood derivatives market. Efforts by Congress to make these trades and investments less risky and more open to scrutiny have been met by resistance by the financial community so much of their lobbying efforts are directed at getting these regulations changed.

Another big rule change that the bankers are spending millions to try to keep from going into effect is called the Volker Rule, which seeks to limit the type of proprietary trading that banks can engage in. This used to be covered under the Glass-Stiegel Act, which made a clear distinction between a bank and a financial casino. The difference being that a bank is an integral part of the financial fabric of society and therefore to be regulated to ensure that they don’t fail. The casino, well, all bets are off. But if the Wall Street’ers have their way, they’ll get to keep the rules in their favor and when they roll craps, they’ll turn to the taxpayers for relief……again.

My take:

So how come buying off lawmakers isn’t seen for what it is…bribery? Are we saying that the people we send to Congress aren’t smart enough to make laws based on what they know to be the pertinent issues and that if necessary, consultations with those affected by the laws isn’t enough. What are They Learning in College?

President Barack Obama highlighted education as a primary object of his administration’s focus and that includes the area of runaway costs at our colleges and universities. The President further reinforced the message at a speech at the University of Michigan, where he hinted that perhaps federal aid to the colleges would somehow be tied to cost controls at these institutions, a notion that got the attention of many college Presidents. Their initial reaction was that any cut in funding from the feds could undermine the quality of the education in our colleges. But that leaves the question, how do we measure and evaluate the quality of the education at these schools?

The President proposed, as an incentive for received federal aid, that the colleges be graded on lower costs, graduation rates, and the ability of your graduates to find a job. However, nowhere on this metric is the quality of the education actually being graded except in it leading to a paycheck. A recent study by two professors, one at New York University, and the other from the University of Virginia found that after tracking several thousand students in twenty four universities, almost 50% of these students didn’t improve their reasoning or writing skills in the first two years of college. Four years later more than 33% had still not improved in these areas of study.

Their assessment was based on a college test called the College Learning Assessment or CLA, which tests college students for the ability to read, think, reason, and then write in a coherent, logical manner based on what the evidence and information presented in the test.  The test was given to 2,400 students in 24 colleges – a sampling from big state colleges, to selective liberal arts schools to those schools that have been historically African American and Latino based.

The students fared poorly with researchers concluding that most didn’t improve their abilities in these critical areas of education because most weren’t challenged in these subjects while in their freshman and sophomore years in school. When interviewed, many said that they study less than 12 hours per week, and that some aren’t even required to write more than 20 pages combined in all their classes.

Some colleges are already addressing the problem by requiring their students to write a series of papers in the first two years of school and those that do not meet the standards set by the school are required to seek assistance in getting up to speed. So while the rising cost of higher education is indeed a problem, perhaps the bigger problem is making sure that our children are actually benefitting, meaning getting an education, from the money being spent.

My take:

The only real way that parents looked at whether you are doing well in college is from your grades and then of course if you can get a job in your field. I never thought about continually evaluating the standards at these colleges, always assuming that they are always up to speed. After all, it is college. We’ll have to see if the college presidents warm to the idea of closer scrutiny of their programs.

China’s Increased Appetite for Gold

It has been reported that China is on something of a gold buying binge of late and many in the commodities markets and outside of finance are wondering why. A recent report by the Hong Kong Census and Statistics Department found that China imports of gold in November increased considerably over those in October and for any month in recent memory.

Industry analysts say that China bought as much as 490 tons of gold in 2011, more than double the total it purchased in 2010. This is a huge increase and many analysts are wondering what is behind the purchases.

The People’s Bank of China, the central bank of China does not release exact details about its purchases of gold or other assets but it has been hinting of late that no asset is safe and therefore they seem to be hedging their portfolio from currency risk by purchasing the hard asset, gold. Market analysts and speculators who seek to profit from knowing that such a large player like China might be a big buyer of gold are all keeping a close eye on the market and the bull in this china shop for indications that their appetite may not be quelled as yet.

However, others will point out that there are many other factors that don’t add up insofar as the Chinese central bank buying so much gold. For one thing, they would never be so obvious about their intentions and thereby allowing others to profit from piggybacking on their buying spree.

The other thing working against the PBOC being a big gold buyer is that gold is an illiquid asset and from all indications, the central bank is badly in need of investments that pay real dividends and that are liquid in order to fund on-going operations at the central bank, in particular their purchases of foreign currency reserves.

The demand for foreign sources of gold (China is the world’s leading producer of gold) is said to be from private investors in the country. Domestic demand from jewelers is satisfied by domestically produced gold so the demand for outside sources is seen to be from private individuals. Many analysts believe that the rush to buy gold by these individuals could be because of their concern that inflation will increase and that overall economic activity in China is becoming unstable. So, they are looking to hedge their portfolios with the best hedge against these risks – gold.

So it seems that the Chinese aren’t without their problems economically speaking. We have been made to fear all things Chinese and that soon this monster is going to take over everything. Perhaps not. And, perhaps the Chinese are finding that managing 1.3 billion people and a growing economy isn’t quite as simple as it seemed just a few short years ago.
